1.Information on how to enter and the prize offered form part of these Terms & Conditions. Participation in this promotion is deemed acceptance of these Terms & Conditions.
2.Competition is open to Australian residents only. Employees and associated agents of Naked Tan Pty Ltd and their immediate families are ineligible to enter.
3.Only one entry per business. Multiple entries will be considered a non-acceptance of these Terms & Conditions and will deem all entries by that business null and void.
4.Competition commences at midnight EST on Wednesday 4 March 2009 and closes at midnight EST on Tuesday 31 March 2009.
5.Entries must be submitted by the business owner or manager of that business.
6.Entrants must complete the official entry form found at www.nakedtan.com.au during the promotional period to tell us in 25 words or less how a Naked Tan Salon System will bring beauty, luxury and passion to your business.
7.Naked Tan Pty Ltd reserves the right at any time to verify the validity of entries and entrants, including an entrant’s identity and place of business, and to disqualify any entry that is not in accordance with these Terms & Conditions or that manipulates or interferes with the entry process in any way. Failure by Naked Tan Pty Ltd to enforce any of its rights at any stage does not constitute a waiver of those rights.
8.Incomplete, illegible, or entries deemed unsuitable in terms of offensive content will be considered invalid.
9.The best entry as judged by the owner and operator of Naked Tan Pty Ltd will win one (1) Naked Tan Salon System valued at $1250 and comprising of 12-month warranty, manual, 375ml Training Solution, 1 litre ‘Natural’ Solution, 1 litre ‘Tanned’ Solution, 250g ‘Crème de la Crème’, 250g ‘Mother of Pearl Body Polish’ 320g ‘Body Cleanser’ 2 x (65cm x 80cm) Salon Posters, 50 x Goddess Loyalty Cards, 100 x Client Invitation Brochures, 100 x Client Shower Caps, 3 x Naked Tan Logo Tops (choose small, medium, or large in black or pink), one (1) Tan Tent OR one (1) retractable ‘Goddess’ banner with carry case (choose between 1.6m high, or 2m high unretracted). Winner’s business details listed in ‘Locations’ on the site www.nakedtan.com.au , potential client enquiries to the office of Naked Tan Pty Ltd via email or phone, suitable in terms of service request, location, or specific nature of enquiry will forwarded to the winner’s business via email or phone as a referral service.
10.Part of the prize for the winner is a profile on their business in the next edition of ‘Beauty Biz’ magazine (ABN 79 614 816 758). Winner will deal direct with ‘Beauty Biz’ magazine in providing necessary information and adhering to the relevant publishing deadline.
11.Only one (1) Naked Tan Salon System will be issued. The whole prize, or part of the prize, or any unused portion of the prize is not transferable or exchangeable.
12.The winning entry will be chosen at the premises of Naked Tan Pty Ltd (ABN 49
131 872 403) 72 Beaconsfield Street, Bexley, New South Wales, 2207 on the basis of originality and appeal by close of business on Tuesday 7 April 2009. This decision will be final and no correspondence will be entered into.
13.The winning entrant will be contacted by Naked Tan Pty Ltd via phone and email on Wednesday 8 April 2009.
14.The Naked Tan Salon System will be couriered free of charge to the business address of the winner within fourteen (14) days of notification.
15.All entrants consent to Naked Tan Pty Ltd using their name, the name of their business, and any written submissions, likenesses, images (including photographs, film and/or voice recordings) across any media for an unlimited period of time for any advertising, marketing or promotional purposes in regard to this or other promotions and/or in regard to any products manufactured, distributed and/or supplied by Naked Tan Pty Ltd.
16.All entries become the property of Naked Tan Pty Ltd which may use at its discretion the contact information supplied for the purpose of marketing, promotion and/or the sale of its products for an unspecified though unlimited period of time.
17.Contact information supplied by entrants will not be supplied to any third parties not directly involved in this promotion, the marketing or post marketing of this or further promotions, and/or sale and/or product enquiries resulting from this promotion with the exception of the winning entrant’s necessary details being available to ‘Beauty Biz’ magazine for the purpose of the business profile component of the prize.
18.If this promotion is not able to be conducted as reasonably anticipated or is interfered with in any way or reason beyond the equitable control of Naked Tan Pty Ltd or its suppliers, it is the sole discretion to the fullest extent permitted by law for Naked Tan Pty Ltd to (a) disqualify any entrant; or (b) subject to any written directions from a regulatory authority to modify, suspend, terminate or cancel the promotion as appropriate.
19.With the exception of any liability that cannot be eliminated by law, Naked Tan Pty Ltd (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loos of opportunity); whether direct, indirect, special or consequential, arising in any way from this promotion including though not limited to the following: (a) any technical difficulties or equipment malfunction (whether or not under the control of Naked Tan Pty Ltd); (b) any third party interference, theft, or unauthorised access in relation to this promotion; (c) any entry or chance of a prize claim that is late, lost, altered, damaged, or misdirected, including whether or not it occurs or occurred after submission and/or after receipt of submission due to any cause under, or beyond the reasonable control of Naked Tan Pty Ltd; (d) any variation in the prize or prize value to that stated in these Terms & Conditions; (e) any unforseen costs or expenses incurred by any entrant and/or the winner in relation to the prize or acceptance of it; (f) any tax liability incurred by an entrant or the winner; or (g) any further costs or expenses incurred by an entrant or the winner in relation to the acceptance and use of the prize.
